Cablevision in a rut
Tom Rutledge gave no reason for his recent exit from Cablevision.
Dolan DolanCablevision stock has taken a hit after chief operating officer Tom Rutledge's exit left a gaping hole in management led by CEO James Dolan and reinforced Wall Street's nagging fear that execs not named Dolan are dispensable at a company whose employee roster and board are heavily populated with family members.According to its latest proxy statement filed with the SEC last spring, James Dolan is the spouse of Kristin Dolan and the brother of Kathleen Dolan, Patrick Dolan, Thomas Dolan, Deborah Dolan-Sweeney and Marianne Dolan Weber; the brother-in-law of Brian Sweeney; and the nephew of Edward Atwood. All of them, as well as patriarch Charles Dolan, are on the board or employees. The ubiquity of the Dolans, who control more than 70% of the company's combined shares, makes it unlikely Cablevision will be sold anytime soon despite sporadic waves of takeover speculation, including fresh rumors sparked by Rutledge's sudden ankling late last week. The highly regarded chief operating officer's departure sent Cablevision's stock tumbling 17% Friday. It closed down 8.4% at $12.75."They're not for sale that I know of," said an exec at another big cable company. He and others noted that talks with larger rival Time Warner Cable fell apart several times in past years over price, at numbers that were significantly higher than where Cablevision now trades. The two companies' NY-area cable systems are contiguous, which would make them a good strategic fit.Rutledge gave no reason for leaving and Cablevision was clearly caught short without a replacement lined up. If he had planned to take a new job, possibly running Charter Communications, his departure would have been timed and handled differently. Consensus is he left after knocking heads with James Dolan, the son of founder and chairman Chuck Dolan.Craig Moffett of Bernstein Research said Rutledge's loss was compounded by the recent departure of John Bickham, former prexy of Cablevision's core cable business. The two execs did such a fine job that it's considered one of the best run cablers around with high penetration in its markets and many customers taking video, voice and data services. Success, however, leaves it less room to expand and less attractive to a potential buyer."Cablevision, we have long argued, is a victim of its own success. And much of that success owes to Tom Rutledge and John Bickham," Moffett said. The company also faces tough competition in its key markets from Verizon FiOS, also based in NY.Cablevision said in a statement it has started a search for an executive with responsibility for oversight of the cable operations. It didn't mention a replacement for COO."Remember how may iterations of this we went through, with Viacom and other companies, where the owner is dominant and there is friction. Like Sumner (Redstone), and Mel Karmazin and Frank Biondi," said longtime media investor Hal Vogel, referring to two former top lieutenants of Viacom chairman Redstone. While 84-year-old Charles, or Chuck, Dolan is well respected, James, who has been CEO since 1995 and executive chairman of Madison Square Garden since 2009, doesn't have the same stature and Wall Street appears generally unimpressed with his leadership, which makes executives like Rutledge and Bickham important. At the division, James is said to like best and follow most closely, MSG and its teams, one Wall Streeter noted, the NY Knicks remain mired in a decades-long slump unusual for a major metropolitan team with cash and one of the world's most famous stadiums behind it. The Knicks were last NBA Champions in 1973.However, his position seems untouchable. "Charles Dolan, members of his family and related family entities are able collectively to control stockholder decisions and to elect up to 75% of the company's board," the proxy said.Members of the Dolan family have agreed to cast their votes as a block. And in something called the Children Trusts Registration Rights Agreement, super-voting Class B stock from the trusts will automatically be converted to Class A stock if sold to anyone outside the family or related parties. They don't always get their way. The Dolan family tried unsuccessfully to take Cablevision private twice over the last decade, in 2005 and again in 2006.And occasionally the family fights itself as in the famous battle over VOOM, a costly HDTV satellite service dear to Charles Dolan that his son James and the board voted to shut down and sell. Dolan tried to buy it with his own cash and filed with the Federal Communications Commission -- against Cablevision -- to block a sale to EchoStar. He failed. But during the battle Charles Dolan ejected three directors and installed handpicked replacements, including Frank Biondi, former ITT chairman Rand Araskog and John Malone. Malone didn't pan out. The Liberty Media chief was publicly dubious about VOOM's chances and left the board shortly after citing conflict of interest in programming assets.Said one media investor: "I asked him why he left the board and he said, 'It's Chuck's company.'" Chase Carey States News Corp Is Going To Do What is Essential To Grow Hulu: UBS Confab
You wouldn’t realize that the Hulu auction would be a failure in line with the way News Corp COO Chase Carey describes the proprietors’ plans. They made the decision to hold onto digital video service because its value for them “dwarfed a few of the values which were being placed on it” by bidders including Dish Network and Google. Keeping Hulu reflects “a judgment this digital space can be quite important and will probably be, within the next 5 years and beyond, the most crucial area we must navigate.” Consequently, he told the UBS Annual Global Media and Communications Conference, “we’ll do what’s necessary to really make it grow.” But that doesn’t always mean adding movies towards the package to really make it more competitive with Netflix.”Me-toos aren’t an excellent place to stay in e-commerce,” Carey states. “We want to check out it having a fresh eye.” Traders oddly appeared uninterested in news reports Around The Globe hacking scandal. But among the effects — News Corp’s decision to abandon its effort to purchase BSkyB — would be a concern. Carey states it’s “one of the things that we must determine” while he states the organization will get”a fraction of credit” itbelieves it warrants because of its 39% stake within the United kingdom media company.News Corp must”do a more satisfactory job interacting value.” Still, he didn’t leave traders empty handed: Carey states that News Corp’s lately released round of share repurchases is “certainly not really a 1-time factor. It’s a significant part in our capital allocation” he stated, adding that News Corp shares are”woefully underrated.” Careyseemed less passionate than his co-workers were in the conference concerning the condition of TV ad sales. The present quarter is “a little much softer than the usual quarter ago,” he states. He needs to determine additional investing at the begining of 2012. Even when he’s wrong, “we’re in an excellent place. We made the decision to market much deeper in to the upfront than anybody else” and there has been couple of cancellations. Meanwhile Fox is relying on an established commodity, The American Idol Show, they are driving the other half from the broadcast season. The talent show is going to be “priority one” for network. “We were thrilled with Idol’s performance” this past year, he states. Even when the ad market disappoints, Carey looks toward additional revenues from retransmission consent deals. “We’re starting to get fair value for which the Fox Network signifies,” he states. And that he states there’s a lengthy approach to take: “If ESPN may be worth $4 (per month for every home it reaches) then Fox may be worth $5.” But he rejects the argument from pay TV companies that programmer efforts to gather more money for broadcast and cable services will increase consumer prices. “Some of that's settling,” he states. “If you create good content you'll, and really should, be paid out.” And although he states he knows “the attraction of having to pay less,” he states that customers “will pay a reasonable cost for any quality experience.” Which should include digital distribution to mobile products that they states will “excite that customer.” Carey states that the organization isn’t always likely to plow that retransmission consent cash into greater listed programming — including sports. “You don’t wish to have indistinguishable, mediocre product,” he states but adds that “you can’t buy everything.” Fox remains thinking about the National football league. “Their value is really unique.” Still, Carey states that “there are costs connected by using it which make you swallow hard…. Sports is really a two pronged sword, and also the National football league may be the ultimate two pronged sword.” For another hot subject in the confab — Netflix along with other digital services thinking about content — Carey states they represent “an exciting new dimension towards the business” but “we don’t view it instead of the broad experience you receive” from pay TV. It assisted with Forex’s Sons of Anarchy, which could have been tough to syndicate. “We are in possession of an industry for this since it works best for Netflix.”Digital alsois an excellent platform for that series 24.”It includes a tail onto it in DVD, but that’s about this.” Meanwhile, News Corp doesn’t sense danger by a number of YouTube’s new channels which include appropriately created content. “I don’t think they’ll by any means, shape, or form become: ‘this is going to be my television experience’,” he states.”Over time you need to work out how they fit in to the bigger hole.” Still, he adds, “you have to be certain you’re making your personal choice, not chasing after everyone else.”

The companyclaims that it closed a deal in late October to create a Hunger Games-branded version of its "China Glaze"nail polish, as well as contribute to the promotional campaignfor the adaptation of the popular Suzanne Collins novelthat Lionsgate is hoping will be a mega-blockbuster movie series similar to Twilight. But shortly after Lionsgate executives signed the contract, according to the complaint, the studio made statements to the press that the deal was "not happening," and askedAmerican to say that the parties "were merely 'discussing' a 'possible' promotional deal." American says it refused to lie, prompting a Lionsgate attorney to send an email on Nov. 17 saying that the studiowas "terminating" the contract. "And the last third, it felt like a flat-out horror movie. Why John C. Reilly Was 'Busted' by Roman Polanski (Q&A)
Since his Boogie Nights porn star Reed Rothchild introduced, with conviction, "People let me know I kinda seem like Han Solo," John C. Reilly has occupied a coveted devote the hearts of cinephiles because the medium's most endearing underdog. Whether he's crooning the sweetly sad "Mr. Clear wrapping" for his Oscar-nominated role in 2002's Chicago, "trembling and baking" with Will Ferrell in 2006's Talladega Nights or playing the father of troubled boy within this fall's dark drama We have to Discuss Kevin, the Chicago native handles to continually inhabit the area between emotional realism and absurdity.our editor recommendsRoman Polanski's 'Carnage': Exactly what the Experts SayJohn C. You question: Are folks Europe getting this? It's occur Brooklyn is movie intended for a united states audience? However it got huge laughs in Italia. These were entertaining it on just like a boxing match! I believe people around the globe can connect with its universal story: parents attempting to resolve conflict with respect to their kids. Every character is absurd in some manner or any other. What's most absurd may be the figures' hypocrisy, and my guy is the first to express: "There's an elephant within the room! This really is absurd! What exactly are we doing?" Being an audience member, you're waiting for your relatable moment. He breaks the strain by saying: "F-- it. This really is who I'm.Inch STORY: Feinberg Forecast: 'Carnage' Divides, 'Extremely' Intrigues, 'Moneyball' Develops THR: For individuals who follow your job, it's been fun to express "John C. Reilly" and "Roman Polanski" within the same sentence. How did this completely different role come your way? Reilly: Honestly, it may sound strange, however it arrived during my lap. Roman really asked for me. Eventually this telephone call comes that states, "Roman Polanski wants you arrive at Paris and shoot a film.Inch Funny enough, I'd really been contacted about doing the play a couple of in the past -- the part that ultimately visited James Gandolfini -- and so i had been very conscious of the fabric. I suppose he or she must have experienced something he loved during my work! FILM REVIEW: We have to Discuss Kevin THR: Likely it had been your nailing the semi-coherent TV commentator Dr. Steve Brule around the late-evening sketch series Tim and Eric Awesome Show, Congrats! I don't know this without a doubt, however i'm speculating you're the only real actor that has made an appearance both in a grownup Go swimming program along with a Polanski film. Reilly: (Laughs.) Yes, you will find most likely a myriad of odd details like this from my career. I've cast a large internet, everywhere, as you would expect. THR: Had you been nervous or reluctant to agree Carnage? Reilly: Reluctant? No. I had been so honored to become requested. However I was certainly nervous. Becoming an actor is much like constantly being the brand new kid in class -- you don't know anybody. I literally didn't know anybody within the cast. A minimum of Roman had met other stars before and understood their personas. But there' was, relaxing in this room, battling to seem like I belonged there. I attempted to embrace it, though. FILM REVIEW: Carnage THR: Have you do anything whatsoever special to organize for that role? Reilly: I just read the play a couple of more occasions, and that i didn't do this for research, however i viewed Chinatown again because I had been so looking forward to dealing with Roman. I needed to refresh myself. Guy, that movie really stands up. The very first time I first viewed it years back, I hadn't lived in L.A. Now, getting been for a very long time, it had been like, "Wow, it is really an incredible story relating to this city." THR: What have you find out about filmmaking from Roman? Reilly: It's funny, however when you're hearing a director, you typically you need to translate the things they say right into a functional note on your own. I've labored with amazing company directors like Martin Scorsese and Robert Altman, however they don't really speak from an actress's perspective sometimes. However with him, it had been like getting another actor dealing with you. He's an excellent feeling of precision of human behavior he will explain should you're doing something false. Throughout rehearsals, I'd have this book during my hands, and I must set this book lower to be able to perform the next little bit of acting, and that he would say: "Why can you place the book lower? You don't realize that you're going to get the bottle yet. You're doing that since you know you'll need both hands free, but that doesn't seem sensible.Inch God, he busted me. He's totally right! He's this type of great eye. THR: Was he as interactive throughout shooting? Reilly: Really, hardly whatsoever. He'd give lengthy notes towards the lighting and seem departments. Using the stars, he'd make certain you had been in your mark, but he wouldn't provide you with direction. Eventually, I began feeling: "Am I getting this? Am I doing the work right?" and that i requested him, "Roman, how's the acting department doing?" and that he goes, "You would like me to stroke your ego?" and that i'm like: "No! I'm just searching for some feedback." And that he stated, "If there is anything wrong, trust me, I'd let you know.Inch Lots of great company directors work this way. You select the best people, make certain you're on a single page and allow them to get the job done. I type of relaxed next. I recognized that Roman informs tales through composition within the photography. I'm accustomed to company directors attempting to tell a tale with the script, with many different concentrate on stars. Following a couple of days, I loose up. THR: You might also need the dark Lynne Ramsay film We have to Discuss Kevin within the honours conversation this season. Does getting made an appearance in 2 noncommercial films consecutively mark a brand new chapter inside your career? Reilly: Well, Carnage is really a comedy, and somewhat, it's pretty playful. But yes, it's not "jokey" like lots of things i've done. I simply think I take what comes my way. It's nothing like I deliberately went into comedy in a certain point -- that chance came about. I believe many people take a look at stars in the outdoors and think: "Ah, he's selected to get this done! And the master plan's this!" However I think should you speak with any actor who's honest with him- or herself, you're always hitching with other people's wagons, just wishing to ride a momentum that's been produced by others. It's another art from as being a painter who's producing their own direction. Really, it's much more about saying no thanks that influences the direction you're going. But what you could agree is much more about luck and exactly what the world really wants to see in a with time. It's altering just a little, but for some time, the only real factor people desired to see were comedies! They couldn't make sure they are fast enough. For me personally, it had been like: "Well, OK, I'm able to be funny in the event that's exactly what the world wants. That's awesome." THR: What are the roles you're still dying to experience? Reilly: I've always aspired to perform a Western. I've really optioned a magazine which i'm searching for a director to defend myself against. It's known as The Siblings Siblings, by Patrick DeWitt. I've also always aspired to play a priest. It's this kind of interesting theatrical and emphatic character I believe I'd be suitable for play. I'm also thinking about tales of survival and exploration I've read lots of books about this stuff. But, gosh, that's a difficult question to reply to. I'm accustomed to giving up towards the randomness of the items comes my way being an actor. I rarely make wish lists. THR: What exactly are you most happy with inside your career? Reilly: The films I created using Paul Thomas Anderson -- Hard Eight, Boogie Nights, Magnolia -- were really personal expressions born from a genuine creative collaboration. Individuals movies also marked the very first time I had been being requested to behave not only "job in" being an actor. I had been area of the storytelling inside a much deeper, a lot more personal way. Actually, the smoothness I performed in Magnolia, the cop, was created from some improv periods Used to do with Paul. I'm really happy with individuals movies. But when it comes to a general effort made, Walk Hard: The Dewey Cox Story was among the greatest endeavors I ever began. We recorded 35 original tunes on the six-month period before we even began shooting the film! I've heard it's a bit of a cult classic among music artists. But is the fact that my personal favorite film? I don't know. It's like picking your preferred kid -- both get their merits and mark a particular amount of time in your existence. I generally don't spend considerable time searching back -- it's too strange. At some point I'll maybe possess a more retrospective attitude for the time being, I'm generally too busy worrying by what I'm likely to do next. MY FIRST SAG JOB: "It had been my first movie, John P Palma's Casualties of War, in 1989. Formerly to that particular I'd been an additional inside a beer commercial, but which was AFTRA. So Casualties was my first SAG job. It had been a milestone moment for me personally -- I never imagined I'd be inside a movie. I was raised doing plays like a kid. Then all of a sudden I've this membership card: SCREEN Stars GUILD. The best factor was getting medical health insurance and being protected when it comes to things i could earn. I'm a large believer in unions. They obtain a bad rap, however i believe they may be an excellent pressure permanently. SAG is a blessing for me personally. I'm able to't imagine what it might be enjoy having to hustle available for healthcare." The Zone
A Swanberry production. Created, directed, written, edited by Joe Swanberg. Camera (color, DV), Swanberg, Adam Winguard seem, John Bosch. Examined at AFI Film Festival (Spotlight), November. 8, 2011. Running time: 70 MIN.With: Sophia Takal, Lawrence Michael Levine, Kate Lyn Sheil, Kentucker Audley, Joe Swanberg, Adam Winguard, Kris Swanberg, Dustin Guy Defa. The most recent inside a blitz of 2011 releases from mumblecore auteur Joe Swanberg, "The Zone" consists of little to lure neophytes into his fold. Contrary, it'll really be considered a harder sell compared to relaxation of Swanberg's oeuvre, because it can serve as nothing more than an autocritique of their own filmmaking (in other words, the 3rd entry within an auto-critique trilogy, after "Silver Bullets" and "Art History"). But though this film mostly finds the helmer exploring ever-much deeper recesses of their own navel, its moments of genuine insight and knack for tugging the rug upend a number of its problems. The prolific Swanberg makes something of the small-empire unto themself together with his number of highly sloppy photos that contains ample self-referentiality and much more ample superfluously naked youthful stars. Though his films are often ugly, there is something to become stated for that filmmaker's steadfast tries to be absolutely modern, as far as that his points of aesthetic reference hew far nearer to the fringes of YouTube (in other words, YouPorn) than the most low-budget indies. Inside a typically Swanbergian touch, probably the most cogent critique that may be laid upon "The Zone" originates from the film itself. "You are worrying about creating movies about worrying about creating movies," states the helmer's real-existence wife, Kris, within the most dramatic of countless 4th-wall ruptures, before evaluating the pic (unfavorably) to "Art History." The director themself finds it tough to argue together with her. "The Zone" is split into three parts, with just the first being clearly imaginary. Within this first, poorest segment, Swanberg spotlights three hipster roommates (Sophia Takal, Lawrence Michael Levine and Swanberg regular Kate Lyn Sheil), as are all lured consequently with a cameraphone-carrying houseguest (Kentucker Audley), inside a kind of no-budget re-development of "Teorema." Following the last seduction, the narrative abruptly halts, and that we see the 3 of Kentucker's paramours (all stars playing themselves, though different selves these were playing formerly) watching the preceding footage using the director (Swanberg). They critique his editing options and explain his heteronormative prejudice, then lengthily prepare to shoot an psychologically draining menage a trois scene. Because the filmmaking process seems to become reaching the purpose of complete meltdown, the pic again changes perspective, and also the two Swanbergs (together with a gurgling infant) discuss the faux behind-the-moments footage which has just performed. Whilst lamenting his narcissism (does mumblecore actually need its "8 1/2" already?), you have to applaud Swanberg's bravery in supplying a glimpse at a few of the damage that his type of intrusively intimate filmmaking can wreak around the associations between his subjects, and between his subjects and themself. The central problem here's that Swanberg continues to be focus from the piece even if he attempts to permit dissenting voices, and the own troubles with finishing the film, with justifying it to his audience, eventually shoehorn the more provocative exterior questions. It might also help when the film-within-a-film at "The Zone's" center were not this type of transparently offhand canvas for Swanberg to experience out his particular various insecurities -- at leastFellini's spaceship were built with a beach to sit down on. As always for that director, the film consists of numerous inventively staged, shakily shot extended nude moments, including one concentrating on a really ugly quilt, and the other including a spray-fresh paint sunburn. Werner Herzog on Acting, Americana, and Journeys Into the Abyss
The hardest-working filmmaker on Earth was back in NY last week, making the latest of what have basically become semiannual tours in support of his movies. Thus what felt like a continuation of last spring’s chat with Werner Herzog, whose latest documentary, Into the Abyss, finds the endlessly curious director exploring one of American society’s darkest. sparsest frontiers: Capital punishment. But don’t call it an issue film. Herzog doesn’t make those, and indeed, Into the Abyss is not without his customary wit, openness and inquisitive fervor. They abide throughout the story of condemned killer Michael Perry, who, along with his lighter-sentenced accomplice Jason Burkett, rended the fraying small-town fabric of Conroe, Texas, in 2001 with a brutal triple homicide. Herzog talks to parties on all sides of both the crime and its punishment — the convicts, the victims’ families, a police investigator, a death-row chaplain, a prison bride, a retired executioner and more — in search of his cherished “ecstatic truth” of nonfiction filmmaking. That’s not all he’s up to. Herzog’s forthcoming Hollywood acting debut as the villain in Tom Cruise’s One Shot follows another whirlwind of directing projects that would prostrate even Tyler Perry with fatigue. We spoke last week about his agenda, his ambition, and the grave urgency of Into the Abyss. Another press day already! Amazing. I am doing my duty. I wouldn’t complain. Does this get any easier over the years? No, but it is part of your duty as a filmmaker — to somehow bring across a film to an audience. That’s why the media are there. It’s a natural concomitant of what I’m doing. Let me say one thing: I hear filmmakers often complain about it, but I’m not in the culture of complaint. So we have about 15 or 20 minutes to talk, which isn’t a lot less than you had with some of the subjects of this film. How did you get what you needed to get for this film in that time? Well, I’m a filmmaker. I’m not just a fly on the wall. Sometimes you hear filmmakers postulating, “We should be like flies on the wall.” I don’t want to be the security camera in Wal-Mart and record hundreds of hours of something where nothing ever happens. We are storytellers. I get involved. I focus. By the way, when you have 50 minutes only with someone, you have to hit the right tone instantly. So, in a way, you have to know the heart of men to find the right tone. For example, I’m [interviewing] the death-row chaplain — who appears at the beginning of the conversation almost like a TV preacher — and I crack him open. All of the sudden he starts to unravel, and I ask him to tell me about an encounter with a squirrel. And he unravels. And all of the sudden you can look deep inside of him. So… How can I say it? That’s why I’m a filmmaker. The flipside are these long, silent, lingering shots that are so customary in your documentaries: The chaplain, the detective, the wife… The captain of the tie-down team. There’s a long moment of complete silence where he really looks anguished. There’s a written caption before that: He quit his job working in the death house as a tie-down captain at the cost of losing his pension. And I didn’t even put it under his face. I put it on black. Now you are watching his face and there’s nothing — only silence. But the silence is so significant and so anguished. Other filmmakers wouldn’t do that, but I do it. You see, I’m a storyteller, and this is in the story. All of the sudden you have a silent inner story — the parallel story that looks deep inside the human condition. You also chose not to apply your trademark narration to this film. What was your thinking behind that? You have to make your decisions according to the subject. The subject dictates the form. I think it wouldn’t have been right — me as the one who asks questions and has discourse, and then the same voice commenting. And it doesn’t need commentary. Sometimes you have a few written captions to let the audience know some fundamental things: that one of the inmates committed his crimes as an 18- or 19-year-old teenager, and now, 10 years later, he’s facing execution. It’s OK that you know that as audience, but that you know it through captions. What’s the perspective of the film? You state very early on that you are steadfastly against capital punishment, but— Which is OK! I also say I respectfully disagree with the practice of capital punishment. I am a guest of your country, I do not have voting rights. I have a different historical background, and I’m speaking of the Nazi [era] with the genocide and euthanasia and everything. And I would be the last one — I would be the last one — in the position to tell the American people how to handle criminal justice. So that’s why I say, “I have a different opinion, and I respectfully disagree with the practice.” Are you still trying to work out your feelings about America after all these years? Yes. In a way, it’s kind of about Americana — much of what I’ve done. Grizzly Man is Americana in a way, and that’s why it somehow struck a chord with audiences here in the United States. This film, I hope, will strike some sort of a chord, but of course I’m somebody from outside. I have a fresh and different look, but a fascination about Americana — about Conroe, Texas, about an American Gothic, about criminal justice, about families of victims of violent crimes, and on and on. I think the question comes up in another film I made on a death-row inmate. There’s Into the Abyss, which is a feature-length theatrical film, but parallel to that, I have filmed with other death-row inmates for a series of shorter films for television. Those are more focused on just one person. One of them, who was 23 minutes away from execution, got a stay. He tells me about his last trip from death row — which is in Livingston, Texas, but they don’t have a death chamber. So they’re transported 43 miles to Hunstsville, to Walls Unit, where they have a death house. And for the first time in 17 years, he sees trees. He sees other cars; he’s riding in this van. Actually, I did this trip now with a camera, because he says something very, very beautiful: Seeing an abandoned gas station, for example, or seeing a cow in a field is something very magnificent. And he says for him, it was like Israel — it was like the Holy Land. All of the sudden I look at America — the forlorn, kind of bleak part of Texas between Livingston and Huntsville — and everything appears like the Holy Land. You see, because of this project and talking to death-row inmates, my perspective has shifted somehow. And it’s not just America. If I travel from Munich to the village where I grew up, this is holy land. I’ve asked a few people about this recently, but what is it with the enduring preoccupation with America — particularly Texas, or these forlorn stretches — for foreign filmmakers? To visit, to explore— But I’m not a visitor; I live here in America. Of course, but before that. Or, say, something like Stroszek. I am a guest, but I am still a Bavarian deeply entwined in my culture. I have moved to a different country, but I’m still attached to my own culture. I guess I’m wondering if there’s something to reconciling the European experience with the American experience. I don’t have to reconcile with America. I love the country. Otherwise I wouldn’t live here. And I love my wife. Otherwise I wouldn’t live in America, let’s face it. Of course in some questions I have an ambivalent feeling, like probably every citizen has some ambivalence about his home country. And I respectfully disagree with certain things that I see. It’s as simple as that. And you can have a very civil discourse about capital punishment with people in Texas. It’s very easy, and the respectfully differ from my opinion. But America is such a fascinating country, and I’ve looked at it with more and more fresh eyes recently. What have you seen, aside from what’s presented in Into the Abyss? Well, for example, talking with every single death-row inmate, I ask them, “How should we conduct our lives — we outside? How should we do it right? You have not done it right.” And it always comes down to something I have almost overlooked in recent years: Family values. Small family values. In a way, almost like Hollywood movies are insisting on small family values. They prevail at the end of a movie; there has to be a happy end, and they prevail. I kept looking down at it a little bit, and all of the sudden, it moves dead center: These guys are right. Yes. And then I look at family values with great intensity — with much more sympathy, with much more attention than ever before. Does any of that have to do with your age? Getting older? No. No, it has nothing to do with age. It has to do with insight. And insight doesn’t come from me — from thinking. It comes because I have been in intense contact with men and one woman on death row.

Arbitration clauses upset creatives
Charlie Sheen's lawyers looked for any public trial, nevertheless the situation visited arbitration anyway.
Charlie Sheen's situation against Warner Bros. has settled, the theatrics in the dispute transformed having a conciliatory tone. Just one problem remains a ongoing way to obtain discontent inside the legal community: arbitration. Before Sheen and Warner Bros. found terms with an undisclosed amount, they squared off in the courtroom, with Sheen's reps anxious to own his situation heard in the public proceeding as well as the studio likely to enforce a clause within the contract which will have put it within reach of an arbitrator, typically a outdated judge, with many everything carried out private. Despite the fact that Sheen situation is yesterday's news, it uncovered a extended-residual flashpoint between talent's legal reps and studio general counsels. The whole reason behind arbitration wound up being to obtain disputes using the system at greater speed reducing cost. Litigants, i.e., stars and designers suing art galleries, usually over their share in the post sales, say it'll neither. The equipment, it is said, has morphed into the one that favors the art galleries, specifically if this involves accounting and distribution of profits, which describes why it's a studio standard to demand that contracts include arbitration clauses. "Can we really get yourself a fair shake as representing talent which we haven't any jury, which we now have punitive damages waived which we now have most of the alternative activities that are triggered through getting arbitrations instead of suit? I don't think so," Michael J. Plonsker of Robins, Kaplan mentioned inside a recent panel of litigators that we moderated just before the Beverly Slopes Bar Assn. Inside the Sheen situation, his attorney Marty Singer contended that his contract's arbitration provision was "unconscionable." Basically, even though Sheen was one of the finest-paid out stars on television, he was without choice but to just accept an arbitration provision within the contract. John Spiegel, who repped Warner Bros., challenged the idea Sheen was without leverage to barter, watching he commanded $2 million an instalment and may demand things like an individual hairstylist and rehearse from the private jet. Sheen, Spiegel mentioned, didn't even mention an arbitration clause inside the extended report on things he wanted when his contract emerged for renewal this season. The judge ended up delivering the problem to arbitration, but for the question of when the arbitration clause was "unconscionable," he mentioned that that might be left within reach of ... the arbitrator. This is why, within the Beverly Slopes Bar Assn. panel, Plonsker mentioned the choice in the contract settlement should be to get yourself a studio to actually say, "Go or allow it to restInch to have an arbitration clause. "Send them an e-mail or possibly instructions saying, 'We don't want arbitration,' which makes them say, 'You haven't any choice.' Then, as litigators, we'll obtain the opportunity to express, it's 'unconscionable,'" he mentioned. Also irking these legal reps is always that contract disputes settled in arbitration haven't any precedential value. Plonsker signifies a central repository low of glean particulars about arbitration honours. But thinking about the truth that discretion is often a rationale for arbitration to start with, enjoy that. "We'll haven't any input within the courts regarding the these contracts mean, and every time we start a brand new proceeding, it'll finish up like 'Groundhog Day,' which is not good, for your industry or people representing talent," Plonsker mentioned. "I don't determine if it is good for that art galleries." He found agreement from two others round the panel, Ray Stein of Lining Law and Bonnie Eskenazi of Greenberg, Glusker. Consult with studio reps and they're going to insist that although arbitration clauses are becoming an average, they are still available in settlement, which is faulty to visualise that arbitration favors their side. "We negotiate, and not every our arbitration provisions stay,In . Warner Bros. general counsel John Rogovin mentioned inside an interview. One industry source mentioned that "back in the day talent that asked for the provision, as well as the art galleries opposed. They didn't want time, money and delay from the court proceeding." Frequently reported just like a assistance to both sides is always that an arbitrator can devote "undivided attention," while idol idol judges within the court docket system are overstressed. Art galleries have reason to avoid the dynamic from the court trial: Jury consultants declare that each time a jury needs to select from a star or content creator together with a significant media conglom, David will receive a much more encouraging ear than Goliath. Within the panel, Martin Katz of Sheppard Mullin, which has repped art galleries in several high-profile cases, mentioned, "Once we go back to just what the primary objectives really were on arbitration, that's cost containment and speed to judgment, which we agree regarding argument it doesn't work so competent 10 years later, you now request , what is the fix? Might be the fix scrapping it, or possibly may be the fix identifying the best way to have arbitration provisions that are enforceable but do really streamline the process? In . Until such issues are addressed, you will see plenty of rancor around the clause designed to bring relief. Contact Ted Manley at ted.manley@variety.com

With 'Stronger,' Clarkson Finally at Ease
LOS ANGELES (AP) It may have taken some time, but Kelly Clarkson seems to finally be releasing an album without any drama on the side."Everything is good, everything is happy," she said, laughing brightly during a recent interview to promote "Stronger," released this week. It's a different scenario than her last two albums: She went through public disputes with legendary executive and mogul Clive Davis over her third album and with OneRepublic singer-songwriter Ryan Tedder after her last album was released. They were typical of the bold stances she's taken that proved her to be more than the passive, malleable product of a hit TV competition, establishing her as an artist instead of just a voice."I've been a fighter since I started walking," she said, adding casually and genuinely a line that could be lifted from one of her inspirational songs: "We get one life. You want to make sure that you're living it how you want to live it."Since Clarkson became the first "American Idol" a decade ago, she's established herself as one of pop's most formidable, and successful singers. She's sold over 20 million albums worldwide and landed seven singles in the Billboard Hot 100 top 10, including "Breakaway," ''My Life Would Suck Without You," "Miss Independent," and perhaps her biggest hit, "Since U Been Gone."Clarkson has maintained creative control of her music and career since her "Idol" days, and has written on all of her albums. But her determination to chart her own course has not come without a few battles. In 2007, Davis became concerned over the less commercial sound of Clarkson's third album, "My December," which Clarkson revealed publicly after rumors of a rift; Clarkson later mended fences and called the tension overblown. Then in 2009, Clarkson called out Tedder for musical similarities between "Already Gone," which he wrote for Clarkson, and Beyonce's "Halo," which he also wrote.Clarkson calls her new collection of 13 songs "the easiest record that I've made with my label." But she makes clear that's because the suits bent to her will not the other way around."I think people project on you like the formula that has worked in the past. And then they get to know you," she said. "(Now) they know me better as an artist, they know me better as a person. They know what I'm going to do and what I don't like, and it just really works."Sonically, "Stronger" doesn't tinker much with the formula that has helped Clarkson become the top-selling "Idol" artist ever, blending clean pop-guitar riffs with contemporary dance synths. But there is an undertone of loneliness and sadness coursing throughout, including some downbeat lyrics co-written by Clarkson herself."Hello, is anybody listening? Won't somebody show me that I'm not alone," she sings on "Hello.""If you look at my whole catalogue, there are far more sadder songs than happy," the Texan acknowledges in her Southern drawl. "But that's only because writing is a form of therapy. So obviously the things that you're getting out are the things that you've been going through and struggling with. You want to keep all the happy inside. If I'm going through a hard time, I write it out."In person, Clarkson is bubbly and quick to laugh, sharing that in her time off, she picked up the violin and started learning Italian with Rosetta Stone. "I'm horrible at it so far," she laments lightly. But she never comes close to revealing the subject of "Stronger's" multiple scornful breakup and kiss-off songs. "You don't know a thing about me," she sings on the first single, "Mr. Know It All." And it's true that the 29-year-old retains an enigmatic air, despite her down-to-Earth image.Toby Gad, who co-wrote and produced two songs on "Stronger," had planned on a 10-minute meeting with Clarkson when the two first met, but ended up at a two-hour dinner."She's a very strong survivor, and very organic and very real," he said. "You can connect with her on a very human level."Still, after the dinner and several days of revising lyrics alongside the pop star, he said he doesn't remember if she ever mentioned her own relationships to him. While Clarkson seems to sing almost exclusively about the ups and downs of love, her songs are often deceptively universal. Clarkson says "Mr. Know It All" could apply to her own record label or to the media, and Gad's "The War Is Over" functions as a coda to a romance or to an actual war."That's the underlying theme for her, to vent emotions that we all feel in our relationships," Gad said. And Clarkson will continue to vent as she sees fit."I'm always vocal," she said. "People ask me and I tell them. If I have a problem, I say it. I'm never malicious about it, I just say what happened. And I think a lot of people don't do that. So I think it maybe catches people off guard. But I don't know any other way to be but honest musically or personally. So I guess that just comes through."Copyright 2011 Associated Press. Breaking Bad Finale: Who Will Survive the "Face Off"?
Breaking Bad It's the moment Breaking Bad's unrelentingly tense fourth season has been building to ever since Gus wielded that bloody box cutter in the premiere.Breaking Bad postmortem: Giancarlo Esposito reacts to the premiere's most gruesome sceneAfter being unable to blow Gus (Giancarlo Esposito) to bits in the season's penultimate episode, Walt (Bryan Cranston) and Jesse (Aaron Paul) now find themselves scrambling for a Plan B. And the stakes couldn't be higher."[Episode 12] is just a little taste of what is about to happen," Paul tells TVGuide.com. "Everybody is kind of scared for their lives."Indeed, but Paul's character may be in the trickiest spot of all. Jesse spent much of the season being groomed by Gus to replace Walt as the chief meth-cooker. That ultimately led to a bloody fistfight and falling out between the two partners until Walt convinced Jesse that Gus had poisoned the child of Jesse's quasi-girlfriend.Breaking Bad: How far can Walter White fall? But despite the rift between them as late, Paul says Jesse remains loyal to Walt. "I don't think it's hard for Jesse to turn his back on Gus whatsoever. I don't think he was ever really an ally to Gus," he says. "I definitely don't think he trusts Gus. It's very easy for him to make this decision to go after Gus because he knows that he is behind [the poisoning] and that he is just an evil, evil, evil human being."With Walt, Jesse's always wanted to trust him because really, that's all he has left," Paul continues. "I think at this moment in time, he's going to team up with someone that he cares about. He's got his partner back and I think he's happy about it."At the same time, Jesse figures prominently in Gus' plans to find - and kill - Walt. "[Gus has to] make his move before he gets moved on," Esposito says. "He knows that if he can get Jesse out of that hospital and back to cooking, he then can grill Jesse. So he's trying to get Jesse back to the lab so he can really put Jesse on the hot seat and find Walt."AMC orders 16-episode final season of Breaking BadEsposito also says that, although Jesse has threatened to no longer work for Gus if any Walt is killed, Gus no longer has any choice. "He'll have to kill Walt - period," Esposito says. "The game is over. He's just got to take Walt out. He can't negotiate with Walt. It's done. And he thinks Jesse will cook even though he says he won't do it. ... I don't think Gus is as worried as he probably should be. He believes he is still a few steps ahead."Paul, however, doesn't think Jesse will just roll over any more. "This season, you finally saw Jesse stand up on his own and take charge, take control," Paul says. "It was nice to finally not be beaten down, but be the one shooting the gun. Jesse is coming into his own and I think he's going to take that stand and show who he truly is. He's not going to be used as a pawn anymore."Pawn may just be the best word to use, given creator Vince Gilligan's repeated use of chess analogies to describe the battle between Gus and Walt this season. But who will be checkmated in the (final?) showdown between these two men?Check out photos of the Breaking Bad cast"It's the culmination of a lot of chess playing, a lot of gamesmanship," Gilligan says of the episode, appropriately titled "Face Off." "This really is Spassky versus Fischer, and we're not going to know until the very end which one is Spassky and which one is Fischer. Hopefully, it will be a hell of a chess game. I'm hoping the main thing people say when it's all over is, 'Wow!'"Paul doesn't think Gilligan has anything to worry about in that regard. "You truly haven't seen anything yet," he says. "People are going to be screaming and yelling at the television set multiple times and definitely [be] on the edge of their seats. They're going to struggle to hold on. It's definitely a crazy ride."Breaking Bad's Season 4 finale airs Sunday at 10/9c on AMC.

Universal Hopes to Reboot 'Scarface' With New Film
If Moviefone were a hacktastic entertainment website, you might go to a reference here for the infamous Tony Montana line, "Greet my little friend!" Just for the sake, however, we're not. (Mostly.) Deadline reviews that Universal is wanting to incorporate a completely new chapter for the story of 'Scarface' getting a movie that will mix aspects of both 1932 version with Paul Muni as well as the 1983 version with Al Pacino together with a mountain of cocaine. Unsure yet on locale or plot, but expect the completely new film -- whether or not this really happens -- to follow along with together with near the plot of both previous efforts: an immigrant involves America, increases up in the underworld and can obtain the comeuppance he so highly warrants. Put yet another way: "In this country, you gotta increase the risk for money first. Then when you're getting the money, you obtain the power. Then when you're getting the power, then you definitely certainly have the women." The 1983 version of 'Scarface' from director John P Palma hit Blu-ray captured. See the trailer below.
